Welcome to SWAVYA. These Terms & Conditions govern access to and participation in the SWAVYA platform, its nodes, projects, research, and associated services. By accessing or participating in SWAVYA, you agree to these terms.

Purpose

SWAVYA exists to help communities identify needs, organise capability, coordinate projects, preserve knowledge, and support development within the limits established by the SWAVYA Constitution and Constitutional Protocol.

Participation does not create ownership over SWAVYA, its communities, projects, data, or constitutional structures unless explicitly stated through separate agreements.

Participation

Participation is open to individuals, groups, organisations, enterprises, institutions, foundations, and public bodies.

Participants agree to: provide accurate information; submit genuine evidence and documentation; act in good faith; respect constitutional requirements; avoid fraudulent, misleading, unlawful, or harmful conduct.

SWAVYA may suspend or remove participation where these conditions are breached.

Projects

Projects may only proceed after satisfying applicable constitutional, operational, and verification requirements. Approval of a project does not guarantee funding, participation, completion, commercial success, or any particular outcome. Projects remain subject to constitutional constraints, available resources, and verification processes.

Contributions

Participants may contribute time, labour, skills, equipment, facilities, services, knowledge, funding, research, transport, mentorship, or other forms of assistance. Contributions are recorded within participant records where verification requirements have been satisfied. False claims regarding contributions may result in removal from the platform.

Funding

Funding may take multiple forms, including donations, grants, sponsorships, project contributions, revenue-sharing arrangements, and other approved mechanisms. Funds may only be released in accordance with applicable verification and governance requirements. SWAVYA reserves the right to suspend, delay, investigate, or refuse funding transactions where concerns arise regarding legality, authenticity, compliance, fraud, misuse, or constitutional incompatibility.

Verification and Auditing

Certain activities require verification. Verification may include identity checks, address verification, organisational verification, documentation review, project audits, financial audits, site inspections, and other forms of review. Participants agree to cooperate with reasonable verification requests. Submission of forged, misleading, altered, or fraudulent documentation may result in permanent exclusion from participation.

Intellectual Property

Participants retain ownership of content, materials, and intellectual property they create unless they explicitly agree otherwise. By submitting content to SWAVYA, participants grant SWAVYA a non-exclusive licence to display, store, organise, verify, and process that content for operational purposes. Research documents, constitutional materials, protocols, methodologies, and system architecture remain subject to their respective ownership and licensing conditions.

Records

SWAVYA maintains records relating to participation, contributions, projects, verification activities, and platform operations. Records may be retained to support transparency, auditing, fraud prevention, constitutional compliance, research, and continuity of operations.

Constitutional Supremacy

The SWAVYA Constitution and Constitutional Protocol govern the operation of the system. Where a conflict exists between ordinary operational rules and constitutional requirements, constitutional requirements prevail.

Limitation of Liability

SWAVYA provides infrastructure, coordination mechanisms, verification processes, and supporting services. SWAVYA is not responsible for decisions made by participants, actions of third parties, project outcomes, commercial outcomes, personal disputes, or external events beyond reasonable control. To the maximum extent permitted by law, liability is limited to the amount directly paid to SWAVYA by the participant in relation to the matter giving rise to the claim.

Amendments

These Terms & Conditions may be updated from time to time. Material changes will be published through the platform. Continued use of SWAVYA following publication constitutes acceptance of the updated terms.
